(AP) ? Ecstatic baseball fans packed the streets of San Francisco on Wednesday for a confetti-drenched parade and rally honoring the World Series champion Giants ? a Halloween treat made even sweeter as a repeat performance from 2010.

Tens of thousands of people decked out in the team's holiday-appropriate orange and black stood 30 deep behind barriers, climbed trees, camped out overnight and mounted rooftops for a chance to see their favorite players wave from convertibles and get serenaded by Tony Bennett singing "I Left My Heart in San Francisco."

Giants Manager Bruce Bochy, who hoisted the World Series trophy from the back of a gold Rolls Royce during most of the 1 1/2-mile procession, credited fans and his players' "unselfish play" for helping to lift San Francisco to its second World Series victory in three years, an improbable double play for a franchise that had not won the title since 1954.

"In 2010, we characterized the club as misfits that came together and got it done," Bochy told the roaring hordes gathered for the rally in Civic Center Plaza. He said the tagline of the 2012 Giants was "never say die," a reference to the team's come-from-behind, post-season dominance.

"I thank you for always being there, for never giving up," he said. "Thank you for showing up wherever we've been and making this one of the greatest moments of my life."

As with the 2010 parade, this year's two-hour edition drew a cross-section of the region's diversity, from children who were allowed to skip school to older couples who had been Giants fans since the team arrived in San Francisco from New York in 1958.

Series MVP Pablo Sandoval, who swatted three home runs in his first three at bats in Game 1, and second baseman Marco Scutaro, who batted in the winning run of the game that clinched the title, addressed the throngs at the rally in Spanish.

"This is the second, but there are going to be a lot more," Sandoval said, expressing special thanks to the Bay Area's Latino community. "You should enjoy this and feel this in your hearts."

Casandra Buenrostro, 25, who arrived at the plaza at 5 a.m. so she could get pictures of Sandoval, did.

"He made me cry," Buenrostro said. "He's an inspiration."

Earlier in the day, clouds of black, orange and white confetti were shot from cannons positioned on roofs and along the canyon-like, skyscraper-lined street. It showered spectators and parade participants, who included legendary Giants alumni Willie Mays, Willie McCovey and Juan Marichal and politicians such as House Minority Leader Nancy Pelosi.

The unifying energy of the Giants' latest victory was evident as San Francisco 49ers quarterback Alex Smith drove the car carrying Giants pitcher Matt Cain and his family, while 49ers coach Jim Harbaugh did the honors for the Giants' Brandon Belt.

The convertibles gave fans clean views along the parade route that began at the foot of Market Street near San Francisco Bay and ended on the steps of City Hall, across from the overflowing plaza.

Star reliever Sergio Romo, wearing a T-shirt that read, "I just look illegal," whipped the roaring crowd into a frenzy when he got out of his convertible and mingled.

"It's unbelievable! Unbelievable! Just great!" said fired-up right fielder Hunter Pence, who was acquired in a midseason deal and led pregame pep talks. At the rally, Pence persuaded his teammates to jump around the stage to demonstrate the ritual.

"I loved it when they started acting goofy," said Janet Clark, 55. "That's exactly who the Giants are."

With the victory parade coinciding with Halloween, costumed masses brought an even more festive feel to what city officials hoped would be a family friendly, alcohol-free event.

Richmond resident Kevin Yarbrough wore a giant white panda costume in tribute to Sandoval, whose nickname is the "Panda."

"You've got to come out and celebrate like this. You meet a whole new family, make new friends, and it really lets the community celebrate in a positive way," he said.

San Francisco police spokesman Michael Andraychak said a handful of people were arrested for public intoxication and officers issued a few citations for fighting, but the crowds generally were cooperative.

Some fans carried brooms as a reminder of the Giants' four-game sweep of the Detroit Tigers. Later, San Francisco Mayor Ed Lee handed Giants President Larry Baer a ceremonial metal "broom to the city" along with the customary key.

Alex Warlen and Kelly Simms, both 17, were among the hundreds of people who camped out overnight in the plaza to ensure they had prime viewing spots. Warlen is a pitcher and Simms a catcher for the softball team at San Francisco's Mercy High School. The team is co-champion of its division.

"Buster is the reason I'm a catcher," read a sign Simms carried, referring to the Giants' Buster Posey. The high school seniors said Mercy administrators gave students the day off, so they weren't cutting school.

"We would have skipped anyway," Simms said.

Keep moving and have fun with interactive fitness system

ScienceDaily (Oct. 30, 2012) ? People are moving less and less these days. Fraunhofer researchers have developed an interactive learning system that is supposed to motivate the user to move more but in a playful way: They have combined a sensor mat with an activity monitor. Children and adults can use the system to stay fit and learn at the same time. The highlight: The system records the intensity of the physical activity and immediately displays it.

Physical activity is extremely important- this applies equally to both young and old. People who exercise regularly are healthier, are rarely overweight and increase their power of concentration. Staying physically and mentally fit -- with the interactive learning system HOPSCOTCH every age group can do this easily and playfully. HOPSCOTCH consists of a sensor mat that is subdivided into nine fields, and each field has several letters and a number in it. The mat is connected to a monitor via a cable, and tasks from various fields of knowledge are displayed on the monitor. In order to complete the task the user presses on the fields of the sensor mat in the correct order and enters words or numbers. Dr. Martina Lucht, a media scientist at the Fraunhofer Institute for Digital Media Technology IDMT in Ilmenau, came up with the idea for the mat when she saw a hopscotch grid drawn on the street.

Sensor records the intensity of physical activity

Lucht and her team worked closely with researchers at the Fraunhofer Institute for Integrated Circuits IIS in Erlangen to further develop HOPSCOTCH and added ActiSENS, a motion sensor that measures physical activity that was developed by Fraunhofer IIS. ActiSENS registers all of a person's movements, records their intensity and then rates them. The module determines whether the user simply tapped the fields with their foot or actually jumped and hopped on them. The feedback is displayed on the monitor in real time using five bars. ?It doesn't just matter whether or not the task was completed, but also how. ActiSENS tells the user whether or not they have moved enough," explains Martin Rulsch, a computer scientist at Fraunhofer IIS. ?The goal is to motivate the user to move more and have fun."

The small sensor is housed in a box that is hooked to the user's belt. The data is read in real time and transmitted via Bluetooth to a terminal device, such as a television. ?But a cell phone can also be used as an output device," says Rulsch. The data can also be saved to a flash memory and transmitted to a PC later to evaluate it.

The concept's possible areas of applications are varied: in schools it can be combined with language and gym classes -- this doesn't just benefit overweight or hyperactive children. Studies have shown that there is a growing number of students who can no longer perform simple tasks such as walking backwards or standing on one leg due to a lack of physical activity.

But older adults in rehab centers and retirement or nursing homes can also profit from the innovative movement concept that motivates people to move more in a lasting way. It can be used in parallel with physical therapy, for example to train muscles after operations. Since ActiSENS accurately calculates net movements and the level can be modified to the individual's endurance, which prevents it from over- or under-challenging the individual.

The researchers at Fraunhofer IIS and Fraunhofer IDMT will be presenting their system at the Medica 2012 trade fair in D?sseldorf from November 14-17 at the Fraunhofer joint booth in Hall 10, Booth F05.

Facebook shares fall as lock-up period expires

(Reuters) - Facebook Inc shares fell 4 percent in busy trade early on Wednesday as the company allowed employees to start selling some stock.

The world's largest social network waived a provision that prevented employees from selling shares until November 14. As a result, Facebook staffers were able to sell their vested shares on Monday. About 234 million shares held by employees were eligible for sale in the public market.

However, because the markets were closed on Monday and Tuesday in the wake of powerful storm Sandy, Wednesday was the first trading day.

"I don't really understand why Facebook (chose) to unlock virtually all of its compensation within the year of its IPO, but they did," said Michael Pachter, an analyst with Wedbush Securities.

"They made a mistake and set the company up for volatility."

More than 1 billion Facebook shares held by employees, insiders and early investors are set to become available for trading by year's end.

Facebook suffered a painful public debut earlier this year, as investors worried about the company's ability to keep up revenue growth and the large pool of additional shares in the lock-up that are now hitting the market.

Wall Street also has cast a gimlet eye on Facebook and its ability to attract mobile revenue as more people turn to smartphones and tablet devices to access the Web.

Last week, Facebook said it increased mobile advertising revenue at a faster than expected pace, totaling $150 million in the third quarter. Estimates had pegged mobile revenue at $40 million to $50 million in the second quarter.

Shares of Facebook are down more than 40 percent since the IPO. The stock was down 3.8 percent at $21.11 on Wednesday morning, off an earlier low at $20.73.

7.4 million wake up in the dark: Sandy leaves death and destruction in wake

NEW YORK (AP) ? As Superstorm Sandy marched slowly inland, millions along the East Coast awoke Tuesday without power or mass transit, with huge swaths of the nation's largest city unusually vacant and dark.

New York was among the hardest hit, with its financial heart in Lower Manhattan shuttered for a second day and seawater cascading into the still-gaping construction pit at the World Trade Center. President Barack Obama declared a major disaster in the city and Long Island.

The storm that made landfall in New Jersey on Monday evening with 80 mph sustained winds killed at least 16 people in seven states, cut power to more than 7.4 million homes and businesses from the Carolinas to Ohio, caused scares at two nuclear power plants and stopped the presidential campaign cold.

The massive storm reached well into the Midwest: Chicago officials warned residents to stay away from the Lake Michigan shore as the city prepares for winds of up to 60 mph and waves exceeding 24 feet well into Wednesday.

"This will be one for the record books," said John Miksad, senior vice president for electric operations at Consolidated Edison, which had more than 670,000 customers without power in and around New York City.

An unprecedented 13-foot surge of seawater ? 3 feet above the previous record ? gushed into Gotham, inundating tunnels, subway stations and the electrical system that powers Wall Street, and sent hospital patients and tourists scrambling for safety. Skyscrapers swayed and creaked in winds that partially toppled a crane 74 stories above Midtown.

Right before dawn, a handful of taxis were out on the streets, though there was an abundance of emergency and police vehicles.

Remnants of the former Category 1 hurricane were forecast to head across Pennsylvania before taking another sharp turn into western New York by Wednesday morning. Although weakening as it goes, the massive storm ? which caused wind warnings from Florida to Canada ? will continue to bring heavy rain and local flooding, said Daniel Brown, warning coordination meteorologist at the National Hurricane Center in Miami.

As Hurricane Sandy closed in on the Northeast, it converged with a cold-weather system that turned it into a monstrous hybrid of rain and high wind ? and even snow in West Virginia and other mountainous areas inland.

Just before it made landfall at 8 p.m. near Atlantic City, N.J., forecasters stripped Sandy of hurricane status ? but the distinction was purely technical, based on its shape and internal temperature. It still packed hurricane-force wind, and forecasters were careful to say it was still dangerous to the tens of millions in its path.

While the hurricane's 90 mph winds registered as only a Category 1 on a scale of five, it packed "astoundingly low" barometric pressure, giving it terrific energy to push water inland, said Kerry Emanuel, a professor of meteorology at MIT.

Officials blamed at least 16 deaths on the converging storms ? five in New York, three each in New Jersey and Pennsylvania, two in Connecticut, and one each in Maryland, North Carolina and West Virginia. Three of the victims were children, one just 8 years old.

Sandy, which killed 69 people in the Caribbean before making its way up the Eastern Seaboard, began to hook left at midday Monday toward the New Jersey coast. Even before it made landfall, crashing waves had claimed an old, 50-foot piece of Atlantic City's world-famous Boardwalk.

"We are looking at the highest storm surges ever recorded" in the Northeast, said Jeff Masters, meteorology director for Weather Underground, a private forecasting service.

Sitting on the dangerous northeast wall of the storm, the New York metropolitan area got the worst of it.

An explosion at a ConEdison substation knocked out power to about 310,000 customers in Manhattan, said Miksad.

"We see a pop. The whole sky lights up," said Dani Hart, 30, who was watching the storm from the roof of her building in the Navy Yards.

"It sounded like the Fourth of July," Stephen Weisbrot said from his 10th-floor apartment.

New York University's Tisch Hospital was forced to evacuate 200 patients after its backup generator failed. NYU Medical Dean Robert Grossman said patients ? among them 20 babies from neonatal intensive care that were on battery-powered respirators ? had to be carried down staircases and to dozens of waiting ambulances.

Not only was the subway shut down, but the Holland Tunnel connecting New York to New Jersey was closed, as was a tunnel between Brooklyn and Manhattan. The Brooklyn Bridge, the George Washington Bridge, the Verrazano-Narrows Bridge and several other spans were closed due to high winds.

A construction crane atop a $1.5 billion luxury high-rise in midtown Manhattan collapsed in high winds and dangled precariously. Thousands of people were ordered to leave several nearby buildings as a precaution, including 900 guests at the ultramodern Le Parker Meridien hotel.

Alice Goldberg, 15, a tourist from Paris, was watching television in the hotel ? whose slogan is "Uptown, Not Uptight" ? when a voice came over the loudspeaker and told everyone to leave.

"They said to take only what we needed, and leave the rest, because we'll come back in two or three days," she said as she and hundreds of others gathered in the luggage-strewn marble lobby. "I hope so."

Trading at the New York Stock Exchange was canceled again Tuesday ? the first time the exchange suspended operations for two consecutive days due to weather since an 1888 blizzard struck the city.

Fire destroyed at least 50 homes Monday night in a flooded neighborhood in the Breezy Point section of the borough of Queens, where the Rockaway peninsula juts into the Atlantic Ocean. Firefighters told WABC-TV that they had to use a boat to rescue residents because the water was chest high on the street. About 25 people were trapped in one home, with two injuries reported.

Airlines canceled around 12,500 flights because of the storm, a number that was expected to grow.

Off North Carolina, not far from an area known as "the Graveyard of the Atlantic," a replica of the 18th-century sailing ship HMS Bounty that was built for the 1962 Marlon Brando movie "Mutiny on the Bounty" sank when her diesel engine and bilge pumps failed. Coast Guard helicopters plucked 14 crew members from rubber lifeboats bobbing in 18-foot seas.

A 15th crew member who was found unresponsive several hours after the others was later pronounced dead. The Bounty's captain was still missing.

One of the units at Indian Point, a nuclear power plant about 45 miles north of New York City, was shut down around 10:45 p.m. Monday because of external electrical grid issues, said Entergy Corp., which operates the plant. The company said there was no risk to employees or the public.

And officials declared an "unusual event" at the Oyster Creek nuclear power plant in Lacey Township, N.J., the nation's oldest, when waters surged to 6 feet above sea level during the evening. Within two hours, the situation at the reactor ? which was offline for regular maintenance ? was upgraded to an alert, the second-lowest in a four-tiered warning system. Oyster Creek provides 9 percent of the state's electricity.

In Baltimore, fire officials said four unoccupied rowhouses collapsed in the storm, sending debris into the street but causing no injuries. Meanwhile, a blizzard in far western Maryland caused a pileup of tractor-trailers that blocked the westbound lanes of Interstate 68 on slippery Big Savage Mountain near the town of Finzel.

"It's like a long-tailed cat in a room full of rocking chairs up here," said Bill Wiltson, a Maryland State Police dispatcher.

Hundreds of miles from the storm's center, gusts topping 60 mph prompted officials to close the port of Portland, Maine, and scaring away several cruise ships. A state of emergency in New Hampshire prompted Vice President Joe Biden to cancel a rally in Keene and Republican nominee Mitt Romney's wife, Ann, to call off her bus tour through the Granite State.

About 360,000 people in 30 Connecticut towns were urged to leave their homes under mandatory and voluntary evacuation orders. Christi McEldowney was among those who fled to a Fairfield shelter. She and other families brought tents for their children to play in.

"There's something about this storm," she said. "I feel it deep inside."

Despite dire warnings and evacuation orders that began Saturday, many stayed put.

New Jersey Gov. Chris Christie ? whose own family had to move to the executive mansion after his home in Mendham, far from the storm's center, lost power ? criticized the mayor of Atlantic City for opening shelters there instead of forcing people out.

Eugenia Buono, 77, and her neighbor, Elaine DiCandio, 76, were among several dozen people who took shelter at South Kingstown High School in Narragansett, R.I. They live on Harbor Island, which is connected to the mainland by a causeway.

"I'm not an idiot," said Buono, who survived hurricanes Carol in 1954 and Bob in 1991. "People are very foolish if they don't leave."

Samsung ATIV Odyssey brings even more Windows Phone 8 to Verizon this December

Samsung ATIV Odyssey brings more Windows Phone 8 to Verizon this December

Microsoft's ultimate Windows Phone 8 event mostly expanded on a familiar story, but it did leave us a surprise twist near the end. The company confirmed that Samsung will bring its own Metro-tinged experience to Verizon through the ATIV Odyssey this December. Unfortunately, that's about all we know on an official level: Microsoft even used a placeholder graphic rather than show Samsung's real-world design. However, that awfully familiar-sounding name suggests that Samsung and Verizon are directly exploiting that Odyssey codename which many associated with the ATIV S. If so, we're looking at a device that's not at all far off from a GSM equivalent, keeping the Snapdragon S4, LTE and both 8- as well as 2-megapixel cameras. Whether or not the Super AMOLED screen dips to a slightly lower 4.65-inch isn't as known. Even so, the ATIV Odyssey is at least another sign that Verizon will have much more than a token Windows Phone lineup this time around.

Masco Corp. Earnings: Net Income Wasn't What Wall Street Wanted ...

S&P 500 (NYSE:SPY) component Masco Corporation (NYSE:MAS) reported a lower net income in third quarter, missing analysts? estimates. Masco manufactures and installs building and home improvement products including faucets, cabinets, architectural coatings, and windows.

Earnings season is back and more important than ever. Get our newest CHEAT SHEET stock picks now

Masco Corporation Earnings Cheat Sheet

Results: Net income for Masco Corporation fell to $15 million (4 cents per share) vs. $36 million (10 cents per share) a year earlier. This is a decline of 58.3% from the year-earlier quarter.

Revenue: Fell 0.3% to $2 billion from the year-earlier quarter.

Actual vs. Wall St. Expectations: Masco Corporation fell short of the mean analyst estimate of 12 cents per share. It fell short of the average revenue estimate of $2.08 billion.

Quoting Management: ?Our top line in the third quarter benefitted from the increase in new home construction activity in North America, new product introductions, and from selling price increases,? said Masco`s CEO, Tim Wadhams. ?These positives offset both the slow economic growth in North America and the continued weakening of Euro-Zone economies that we anticipated for the second half of 2012. On an adjusted basis, our margins improved on flat sales to 7.2 percent compared to 6.5 percent in third quarter 2011, driven by our focus on total cost productivity and improved price/commodity relationships. We are pleased with that outcome.During the third quarters of 2012 and 2011, we incurred pre-tax costs and charges of $28 million and $13 million, respectively, related to business rationalization initiatives. We expect full year 2012 business rationalization charges to be approximately $65 million. In the Other Specialty Products segment, as reported, one of the businesses was negatively impacted in the third quarter by a $12 million adjustment to its warranty expense as a result of the periodic review of warranty claim activity, sales volume, demographics and the estimated cost to service anticipated claims. We continue to make progress on our strategic initiatives, which include leveraging our brands, reducing our costs, improving our Installation and Cabinet segments and strengthening our balance sheet. We are encouraged by the continued strength in new home construction activity, driven by the stabilization and improvement of home prices in many areas of the U.S., increasing affordability and demographic trends. These factors should continue to drive demand for new homes over the next several years. Increased new home construction activity benefits virtually all of our businesses, particularly our Installation segment which has improved significantly this year, almost breaking even in the third quarter and which we expect to be profitable in the fourth quarter. In our Cabinet segment, we announced actions during the quarter, including the closure of a manufacturing location and a headcount reduction, which we expect will improve our efficiency and reduce costs by approximately $20 million on an annual basis. While we are committed to returning our Cabinet segment to profitability, we anticipate that big ticket remodeling will remain weak, even though we continue to see modest improvement in overall repair and remodeling activity,? said Tim Wadhams.

Key Stats:

The company has fallen short of estimates for two consecutive quarters. In the second quarter, it missed expectations by one cent with net income of 10 cents versus a mean estimate of net income of 11 cents per share.

Revenue has fallen in the past two quarters. In the second quarter, revenue declined 0.9% to $2 billion from the year-earlier quarter.

News: Internet Radio Coalition Forms To Bring Royalties To Internet ...

October 29, 2012

Last week the Internet Radio Fairness Coalition was?officially?launched. This coalition is made up of several internet and radio broadcast services. They have aligned together for one common goal: to urge congress to support and pass the Internet Radio Act Of 2012.?If Congress passes this act, the royalty system will be apart of internet radio.

?The Coalition?believes that the IRFA will create a sustainable business model for the music industry, giving consumers ?more choices and more products for listening to the music they live; enable artists to earn more money as Internet radio grows; create a marketplace that will attract entrepreneurs to invest in new, innovative ways to deliver music to the public; and drive higher revenues for record labels.?

The IRFA would also:

  • Provide all forms of digital radio the same standard at rate-setting proceedings before the panel of judges on the Copyright Royalty Board;
  • Provide for Presidential nomination and Senate confirmation of CRB judges, and;
  • Promote a competitive marketplace by making it easier for artists and labels to negotiate directly with digital radio services and arrive at a negotiated rate outside the CRB process

Below are a list of ?founding members that form the coalition:

  • 977 Music
  • AccuRadio
  • Clear Channel Media and Entertainment
  • Computer and Communications Industry Association (CCIA)
  • Consumer Electronics Association (CEA)
  • Digital Media Association (DiMA)
  • Digitally Imported

Baby boomer writer conjures up California dreamin - BoomerCafe

?
We love it when baby boomers blossom. And so it is with Mike Petrie, who has reinvented himself a few times. Which is precisely what he writes about in his new book, You?re The Only One I Can Trust. Mike has twice won the Erle Stanley Gardner Mystery Writing award. So we?re pleased to present this excerpt from his murder mystery with a boomer background of California Dreamin?!

Writer and attorney Mike Petrie at home in California.

Uncle Jack was, I suppose, the miscreant black sheep of our family. Standing out amongst all my uptight, conservative, hard-working, ambitious, God-fearing relatives, Uncle Jack shone brightly like some blighted beacon of bohemian unconventionality. Already well over thirty when the whole ?hippie thing? was going on back in the late 1960s, Uncle Jack moved from our deeply-rooted hometown in Illinois toCalifornia, where he embraced that youth subculture anyway?in spite of the ?don?t trust anyone over thirty? Zeitgeist dogma? shunning the mainstream, growing long hair and beard and ?going with the flow? of the counter-revolutionaries. The family dismissed him as a crackpot, but I always admired him.

After graduatingfrom high school, much to my amazement my parents consented to letting me spend the summer with Uncle Jack, for what I?m sure they presumed would be the last few idle months of my life before starting college and advancing into the work world.

That summer of 1971 was a summer right out of any teenage boy?s fantasy. Two months of living on the beach in sunny Southern California! Uncle Jack taught me to surf the small but consistent wave breaks right in front of his house at Venice Beach. By then Uncle Jack would have been in his late forties, but you would never know it; he could surf with the best of them, bike ride along the beach bike path for several hours, and still manage to party long after we watched the sun sizzle into the Pacific right out our front window. He was more like an older brother than an uncle?certainly not at all like someone from my parents? generation.

We would sit on the front deck of the little beach cottage, day after sunshiny day, listening to rock music and flirting with bikini-clad beach bunnies as they cruised past our door on roller skates along the paved path that parallels the ocean for some twenty miles.

So many of the local colorful characters for which Venice Beach is known were among Uncle Jack?s coterie of beach buddies and often stopped by to visit, each with their ownunique tales to share. Blond blues singer, Ricki Lee Jones, was a struggling artist in those days, frequently venting her frustrations with the music business on my patient uncle. Beach Boys drummer Dennis Wilson sat at breakfast with us one morning after surfing with Uncle Jack and told me about the frenetic ?early days? with his famous band. Everything and everybody at the beach just seemed so damned exciting!

[Click here to buy: You're the Only One I Can Trust: A Novel]

Sadly, The Doorssinger Jim Morrison died that very summer. Uncle Jack sat up all night embracing a whiskey bottle? something that was actually rather out of character for my uncle? mourning the passing of the Lizard King, a man he called friend. ?Jim lived just a bit down the beach, but often he?d crash right here,? I vividly recall my uncle saying, pointing a finger in my direction for emphasis and speaking with slurred words from grief and whiskey. ?He?d just wander in, grab a beer from the fridge and crap out on that very sofa you?re sitting on. Jim often said ?No one gets out of this world alive,? guess he?s proven himself correct. I hope he won?t be remembered as just another fallen rock star,? my uncle lamented. ?He was one of the warmest, most human persons you could ever know.?

I enrolled at Berkeley that fall and spent the next four summers with Uncle Jack at the Venice Beach house on Ocean Front Walk. College life was hard work, but fun. Summers were outrageous! Uncle Jack was always there waiting for me to drive down from school. Suntanned and trim, he never seemed to age. I jokingly told him that one day I would be a stooped old man and he would still be surfing the ocean out front of his beach house. He told me that old is more a state of mind than a physical reality and I think he truly believed that. Often he would say things like, ?Time, my dear nephew, is merely an illusion perpetrated by the inane manufacturers of space.? Then he would laugh a hearty chortle. He was frequently spouting off one-liners like that, and I seldom understood their profundity, but always listened and laughed merrily along with Uncle Jack.

I loved my UncleJack and I loved the summers spent with him in that little beach shack morethan anything. But, in the summer of 1976 Uncle Jack took off to sailaround the world on a sailboat with some friends ? a voyage that would take several years. For me, the fun times were over. Stanford Law School, studying for the bar exam and grueling hours spent working at the practice of law consumed my life. Offers arrived in the mail over the years from Uncle Jack, asking me to join him on his sailing voyages ? but I was far too busy. I had become too grown-up to play with Uncle Jack anymore.

Second In Command To Supervise State's Gun Law Agency

by johnny on October 29, 2012

A new task force, pursuant to an article in CNN, scheduled to look at Florida?s permissive gun laws in lieu of untimely demise of an unarmed teenager. A volunteer in the central Florida town of Sanford swore that he shot his 9 mm pistol after a Sanford teen attacked him. Although approved by the NRA-ILA and 24 other states, in consonance with law firms Spohrer & Dodd, Florida?s self-defense laws should not apply and the family members of the Sanford teen might be permitted to file a civil claim since the State of Florida?s were permitted to pursue criminal charges against the neighborhood watch volunteer. Presently, the Sunshine State?s laws furnish a valid defense in a court of law and also have a clause that furnishes immunity from all lawsuits for personal injury as a result of the legitimate use of force.

Wrongful death cases can arise from a multitude of fatal injuries, to include those from an unintentional drowning. A reputable injury lawyer will skillfully discuss claim through the complexities of personal injury law, representing the basis for the lawsuit while quantifying the restitution to which the injured individual is entitled. Prior to talking to the defendant?s insurance carrier check the law firm?s track record for representing lawsuits like yours to make certain you are prepared for court. There is zero wrong with consulting with a lawyer if you were damaged or had a loved one killed in a mishap. Furnishing no cost no obligations legal services before a fair recovery is reached, many firms provide claims preparations free of charge, which is a normal for some law offices.

In your type of accident claim, always do your homework to choose an attorney that is experienced. In spite of where the accident occurred, locating a lawyer that suits your needs is never hard with the large number of personal injury firms available today. Many injured victims don?t pursue a lawsuit for injuries due to an absence of legal know-how. Younger victims may not have the knowledge to contact a reputable accident injury law firm. A settlement will not fix all of your injuries or return a loved one to a grieving family but it can help eliminate some of the monetary pressures. Frequently injured victims simply not protect their rights and never bother with initiating a lawsuit.

Multitude of reports allege SVP of iOS, Scott Forstall, was asked to leave Apple

More details reportedly emerge on SVP of iOS, Scott Forstall, leaving Apple

Now that Apple has announced that senior-vice-president of iOS, Scott Forstall was leaving the company, amid storms and market-closings, various additional information is surfacing on the story, at least from Apple's perspective. Namely, it's now being claimed that Forstall was fired.

First up, Mark Gurman from 9to5Mac got his hands on the memo Apple's CEO, Tim Cook, sent to employees following the news, which unlike the press release, takes the time to thank Forstall.

I am also announcing that Scott Forstall will be leaving Apple next year and will serve as an advisor to me during the interim. I want to thank Scott for all of his many contributions to Apple over his career.

However, Adam Lashinsky from Fortune is being told that things weren't so happy behind Apple's famously closed doors.

It is being said that Forstall didn't get along with Jony Ive. The knighted designer won that battle. Apple named him the chief of all "human interface" on Monday. Reading between the lines, that means software in addition to hardware. Design lovers hated the paper "shredder" that Apple introduced with its Passbook product. Ive, a fan of minimalism, must have hated it too. Watch for Apple to kill it.

Lashinsky also says Forstall refused to sign the iOS 6 Maps apology letter, something echoed by Nick Wingfield of the New York Times:

While tensions between Mr. Forstall and other executives had been mounting for some time, a recent incident appeared to play a major role in his dismissal. After an outcry among iPhone customers about bugs in the company?s new mobile maps service, Mr. Forstall refused to sign a public apology over the matter, dismissing the problems as exaggerated, according to people with knowledge of the situation who declined to be named discussing confidential matters.

Instead, Timothy D. Cook, Apple?s chief executive, in September signed the apology letter to Apple customers over maps.

Chris Ziegler of The Verge has heard likewise.

Sources tell us that Forstall has a reputation for deflecting blame, and with fallout intensifying over the Maps situation, now may have seemed like a good time for Apple to part ways with a man who'd done a good job making enemies over the years: Hurricane Sandy has given the company two days of market close to let investor reaction stabilize. Amazingly, it's said that Forstall's coworkers were so excited to show him the door that they volunteered to split up his workload.

Again, all this reads like Apple's perspective on the matter. Jessica E. Lessin of The Wall Street Journal also repeats the maps and apology letter story, but then offers some perspective from whats seems like Forstall's perspective. First, that he believed Apple could handle maps without apologizing, but also:

Mr. Forstall recently told people that there is no "decider" now that Mr. Jobs is gone, according to a person briefed on the conversation.

Mr. Forstall also recently sent some members of Apple's iOS software team an email saying that he felt the group wasn't working on enough big ideas in mobile software, according to a person briefed on the email.

If there was indeed a power struggle or a contention as to who would guide Apple's products going forward, however, it seems inarguable that Forstall lost. It also seems like Apple was willing to make hard decisions and to sacrifice even extremely talented, long tenured individuals for what they felt was the good of the company moving forward.

If it came down to a choice between Jony Ive (and Bob Mansfield) and Scott Forstall, or of Tim Cook's leadership and Scott Forstall's ambitions, it's tough to argue the call. It's not so tough to see the faith and trust being put into Jony Ive and his design sensibilities, which have so far been manifested more in hardware than software, and Craig Federighi's engineering skills, which have only recently earned him the top spot in OS X, never mind iOS.

This is either an Apple -- and more specifically a Tim Cook -- as rightly confident in their ability to manage people as they are in their ability to project product, or an Apple already fraying at the seams about to experience another serious escalation in load and stress.

I'm very much hoping it's the former.
